Update: EEOC Confirms Finding of Disability Discrimination
An earlier posting on this blog described the EEOC's ruling in favor of a federal job applicant represented by David Wachtel of the Bernabei Law Firm. The Navy then sought reconsideration, arguing that because the complainant had gone to the Office of Personnel Management after he was originally denied a job, the Navy was not at fault. The Bernabei Law Firm argued that it would make little sense for Congress to have given disabled veterans less protection from discrimination than other employees have. On October 9, 2006, EEOC agreed, confirming its earlier ruling and restating the award of six years of back pay, attorney's fees, and other relief.
